By downloading, accessing, or using the GoQrides application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. GoQrides ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Your continued use of the Service following the posting of revised Terms means you accept and agree to the changes.

2. Description of Service

GoQrides is a transportation information and community platform designed for New York City residents and visitors. The Service provides real-time transit tracking, route planning, community-generated reports, and location-based information. We do not operate or own the transit systems we track; we provide information about third-party services.

3. User Eligibility

You must be at least 13 years old to use this Service. If you are under 18, you must obtain parental or guardian consent. By using GoQrides, you represent that you meet these requirements and that all information you provide is accurate and complete.

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Choosing strong, unique passwords

We are not liable for any loss or damage resulting from your failure to protect your account information.

5. User-Generated Content

By submitting content to GoQrides (including reports, comments, photos, and location data), you:

• Grant GoQrides a worldwide, royalty-free license to use, reproduce, and display your content
• Represent that you own or have rights to the content you submit
• Agree not to submit content that is false, harmful, illegal, or infringes on third-party rights
• Understand that your content may be publicly visible to other users

We reserve the right to remove any content that violates these Terms or applicable laws.

6. Prohibited Conduct

You agree not to:

• Harass, threaten, defame, or abuse other users
• Submit false or misleading information that could endanger public safety
• Attempt to unauthorized access the Service or its systems
• Upload malware, viruses, or harmful code
• Violate any local, state, or federal laws
• Spam or engage in commercial solicitation without authorization
• Reverse-engineer or attempt to extract our proprietary data
• Use the Service for any illegal or unethical purpose

7. Third-Party Services

GoQrides integrates data and services from third parties including the NYC Metropolitan Transportation Authority (MTA), mapping services, and other providers. We are not responsible for the accuracy, reliability, or availability of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

8. Location Data & GPS

GoQrides may request access to your device's location. You can grant or deny this permission at any time through your device settings. We use location data to provide real-time transit tracking and personalized recommendations. Your location data is handled in accordance with our Privacy Policy.

9. Payments & Fees

GoQrides may offer premium features, subscriptions, or in-app purchases. By making a purchase:

• You authorize us to charge the payment method on file
• Subscriptions automatically renew unless canceled before the renewal date
• Refunds are subject to our Refund Policy
• Prices are subject to change with 30 days' notice

Payment processing is handled by Stripe and is subject to their terms and conditions.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE." GOQRIDES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE. USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOQRIDES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUE, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify and hold harmless GoQrides, its officers, employees, and agents from any claims, damages, or expenses (including attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

13. Intellectual Property

All content, design, and functionality of GoQrides are owned by or licensed to GoQrides and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute our content without prior written permission.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in New York County for any disputes.
